DUI and Motion to Suppress

The court granted the defendant’s motion to suppress results of a DUI investigation, 
finding that where an officer arrived at the scene of a single-car accident and saw the defendant 
seated at a nearby business that was closed, “the arresting officer did not have sufficient 
information regarding defendant being in actual physical control of the vehicle in order to 
conduct a DUI investigation.”
